1. Purpose
These terms of use govern access to and use of the browser game Sea Sex and Sun (the “Game”) published by Sea Sex and Sun — raison sociale à compléter (the “Publisher”). Creating an account means accepting them in full. Purchases are also governed by the terms of sale.
2. Access to the Game
- The Game is free; some optional content is paid (gems, Premium).
- The Game contains fictional references to crime, drugs and violence: it is not recommended for players under 16. A minor needs the consent of a parent or legal guardian to play and, all the more, to make a purchase.
- The Game is played online; equipment, connection and their costs are the player’s responsibility.
3. Account
- One account per person. Multiple, lent, shared, sold or traded accounts are prohibited.
- The player provides a valid email address and a strong password and is solely responsible for keeping them confidential and for actions taken from the account. A code sent by email is required when logging in from a new device.
- Character names and avatars must not be insulting, discriminatory, sexually explicit or impersonate anyone, including moderators or the Publisher.
4. Code of conduct
The following are prohibited in particular:
- cheating: third-party software, scripts, bots, automation, deliberate use of a bug (bugs must be reported);
- cooperation between accounts of the same person, “farming” one account with another and any scheme to distort rankings, family wars, the market or affiliation;
- selling or buying accounts, resources or services of the Game for real money outside the official shop;
- in chat, forum and private messages: insults, harassment, threats, hateful or discriminatory content, sexual content, incitement to real illegal acts, advertising, spam, sharing other people’s personal data;
- any attempt to compromise the security or proper operation of the Game.
The violence and crime in the Game are purely fictional and must never be a pretext for real behaviour.
5. Messaging, forum and moderation
Players are solely responsible for what they post. Links and insults are filtered automatically. Moderators can remove a message, close a topic and sanction an account. Every player can block or report another player. Chat messages are kept for 7 days.
6. Virtual currencies and items
- Game resources (dollars, alcohol, weed, powder), gems, items and units are virtual items with no monetary value; they are non-refundable, non-transferable outside the Game’s mechanics and can never be converted into real money.
- The player has a personal right to use them for the lifetime of their account and of the Game, without acquiring ownership.
- The casino is a simulated game of chance: only in-game dollars can be wagered; no real winnings are possible and gems cannot be wagered.
7. Changes to the Game
The Game evolves continuously: the Publisher may change balancing, rules and content and add or remove features for the proper operation and interest of the Game. It may suspend the Game temporarily (maintenance, updates) and, if the Game closes for good, will inform players at least 30 days in advance.
8. Sanctions
In case of breach of these terms, the Publisher may, depending on severity, warn the player, remove illegitimately obtained items, restrict chat access, suspend or delete the account, without compensation. When an account is deleted for a serious breach, purchased virtual items are not refunded, unless the law provides otherwise. A sanction can be contested through our contact form.
9. Liability
The Game is provided as is. The Publisher takes reasonable steps to ensure availability and security without guaranteeing that there will be no interruptions or errors. It is not liable for indirect damage, loss of progress caused by the player’s breach, or content posted by players.
10. Personal data
Player data processing is described in the privacy policy.
11. Duration, account deletion
These terms apply for as long as the Game is used. The player may request deletion of their account at any time through our contact form, giving the account’s email address; deletion is final.
12. Changes to these terms
The Publisher may amend these terms. Players are informed of significant changes; continuing to play after they take effect means accepting them.
13. Governing law and disputes
These terms are governed by French law. In case of dispute, the player should first contact the Publisher; failing an agreement, a consumer may use the consumer mediator free of charge: Médiateur de la consommation à désigner (nom, site web), or the European online dispute resolution platform. Otherwise, the courts designated by law have jurisdiction.
